Injunctions

An injunction is a legal order issued by a court that prohibits a person or entity from doing a particular thing. Injunctions can be temporary or permanent, and they are often used to prevent harm or damage from occurring while a legal dispute is being resolved. Common types of injunctions include restraining orders, preliminary injunctions, and permanent injunctions.

Injunctions can arise in a variety of legal situations, but they are most used in cases where there is a dispute over property rights, contractual obligations, or ongoing harmful behavior. Some examples of situations where injunctions may be used include employment disputes and business disputes. Injunctions may be used to prevent an employee from violating a non-compete agreement or from disclosing confidential information. Injunctions may also be used to prevent a competitor from engaging in unfair or illegal business practices.

Injunctions are brought as a remedy where there is an underlying basis for suit. They are brought to maintain the status quo so that the subject or purpose of the lawsuit is not destroyed by one of the parties pending resolution of the issues. Typically, an order enjoining or compelling performance requires a showing of irreparable harm for which monetary damages are not an adequate remedy. An injunction is an extraordinary remedy, and it requires a skilled and experienced attorney to know when it is proper to seek injunctive relief.
